By downloading, accessing, or using the Tonen mobile application ("App") and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Tonen ("we," "us," or "our"). We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

Tonen is a mobile application designed to help neurodivergent individuals prepare for and reflect on social interactions. Our Service includes:

• Tools for planning and practicing conversations
• Features for reflecting on social interactions
• Customizable communication templates and phrases
• Personal note-taking and organization features
• Educational content and resources

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service in any way that violates applicable laws or regulations
• Share content that is harmful, offensive, or inappropriate
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service for any commercial purpose without our written consent
• Reverse engineer, decompile, or disassemble the App
• Upload or transmit malicious code or viruses

The Service allows you to create, upload, and share content such as notes, conversation plans, and reflections ("User Content"). You retain ownership of your User Content, but you grant us a limited license to use, store, and process your User Content to provide the Service.

You represent and warrant that your User Content:

• Does not infringe on any third party's rights
• Does not contain harmful, illegal, or inappropriate material
• Does not violate any applicable laws or regulations

We reserve the right to remove any User Content that violates these Terms or our community guidelines.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

Some features of the Service may require a paid subscription. If you choose to purchase a subscription:

• You agree to pay all applicable fees as described in the App
• Subscriptions automatically renew unless cancelled
• You may cancel your subscription at any time through your account settings
• Refunds are subject to the policies of the app store (App Store, Google Play)
• We reserve the right to change pricing with reasonable notice

The Service, including the App, content, features, and functionality, is owned by Tonen and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

Service Availability: The Service is provided "as is" and "as available." We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

No Warranties: We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Tonen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Service.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Tonen and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.

You may terminate your account at any time by contacting us or using the account deletion feature in the App. We may terminate or suspend your account immediately if you violate these Terms.

Upon termination, your right to use the Service ceases immediately. We may delete your account and User Content, though some information may be retained as required by law or our Privacy Policy.

These Terms are governed by the laws of the jurisdiction where Tonen is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration organization in that jurisdiction.

You waive any right to participate in class-action lawsuits or class-wide arbitration against us.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
